Mental Health Parity Update: Key Takeaways From the Newest Regulatory Guidance and Litigation Trends

The Mental Health Parity and Addiction Equity Act (MHPAEA) requires health plans to provide mental health benefits, including coverage for substance use disorders (SUDs), that are in “parity” with medical and surgical benefits. The exploding opioid and SUD crisis coupled with the soaring rates of mental health conditions post-COVID have put mental health parity in the spotlight, even as understanding and complying with its requirements have become increasingly challenging.
